Terms Of Service

Our Terms Of Service is designed to help protect our customers and the Internet community, from irresponsible or illegal activities. Your signature on the application form (signup sheet) declares that you have read and understood the six conditions outlined within it. If you are dissatisfied with our service or with any terms, conditions, rules, policies, guidelines or practices of Datanet in operating the service, your sole and exclusive remedy is to discontinue your account by emailing us or by faxing us in writing. These policies may be subject to change at any time without prior notice.

I. Primer

This document provides a general understanding of Datanet's policy on the appropriate use of Datanet services. Common sense and judgment are a necessary part of any system of rules, and ours is no exception. Datanet does not monitor the activity of accounts except for measurements of system utilization and billing records. We do our utmost to protect the confidentiality and privacy of the customer. However, in our efforts to promote good netizenship within the Internet community, if we become aware of inappropriate use of Datanet service, we will respond accordingly.

Datanet reserves the right to terminate service with or without notice should a Datanet account be used to violate our appropriate use policy. However, flagrant violations of our appropriate use policy will result in immediate termination of service. All cancellations for the current month must be submitted in writing via email or fax 3 days before the expiring date. All Cancellations submitted by email must be sent to billing@datanet.ab.ca. Once our system is in receipt of your email, you will receive a confirmation e-mail from the system.

In the case of an account renewal, in order to eliminate the possibility of a disruption of internet services, it is the end users responsibility to see to it that payment is received by our office prior to the first day of each month, or by the account maturity date or monthly billing date in the case of a pre-paid account. In the case of monthly billing customers with debits from a credit card, it is the customers responsibility to see to it that Datanet has a current and valid credit card number on file. In the event of an invalid credit card number, the internet service will be suspended until alternate payment arrangements are made.

As good netizens, we prohibit the impersonation of others, unsolicited commercial appeals, and any disruption of Internet services. Examples of such activities are given below:

 

II. Unlimited Access Accounts

In providing dial-up services for access to Datanet's services or to the Internet, Datanet provides equipment that are used on a shared basis by many subscribers. Because the equipment and facilities are limited, it is not appropriate for any subscriber to use the services in a dedicated or automated constant use application, so there is a time out after four hours of use. If the excessive use by an account is such that it potentially impacts Datanet's ability to provide service or network resources that need to be protected, the account can be terminated immediately without notice. Datanet's dial-up accounts are subject to idle timeouts. An idle timeout is a disconnection of a session when a dial-up account is idle for a specified period of time and no interactive, human generated data appears to be received from the remote user's computer system. Automated data is not considered interactive or human generated and is also subject to idle timeouts. Examples of automated data include data generated by an automatic re-dialer, script or other program that runs on the user's computer system for the purpose of avoiding inactivity disconnects or accepting incoming connections. Examples of these activities can include but are not limited to FTP Servers, Web Servers, Email Servers, News Servers, and Proxy Servers, etc.

III. E-mail

E-mail which has been left on our server may be deleted if it surpasses 10 MB and/or has been left on the server for more than 60 consecutive days, and if it has not been read and been left on the server for over 60 days. This will not affect you as long as your e-mail software is configured appropriately. In using email service from Datanet, it is understood that you cannot resell services or offer public information services over dial-up accounts (unlimited usage or otherwise), nor permit more than one log-on session to be active at one time on dial-up accounts unless authorization is provided from Datanet in writing. The system will not allow double log-ins. As a client of Datanet you are prohibited from sending unsolicited bulk e-mail, or from the receiving of responses from unsolicited bulk e-mail in a Datanet e-mail address. You are prohibited from sending e-mail that is terroristic in nature, threatening and/or harassing. You will not intercept or redirect e-mail intended for others. You will not maliciously send files with either corrupted data or viruses. You will not use impersonation, or use a different name or address with the intent of misleading the receiver into believing that the sender is someone other than who they are.
Commercial e-mail:
Sending unsolicited commercial e-mail is prohibited and using a Datanet e-mail address to collect responses from unsolicited commercial e-mail is prohibited.
Mail bombing:
  Sending large volumes of unsolicited e-mail to one user is called " mail bombing" and is prohibited.

IV. News

Datanet does not censor the content of any newsgroups it carries, however Datanet decides what newsgroups we will or will not carry. We believe such choices should be left to the individual and would like to remind you that such tools as Cyber Patrol or Net Nanny, are available to screen access to newsgroups or Web sites you might find offensive. Newsgroup spamming Excessive cross-posting, or posting the same article to several newsgroups, is prohibited. Posting of off topic messages and commercial posting in non commercial newsgroups is also against our policies.

V. General

Datanet assumes no liability and holds itself harmless from any liabilities or losses that may occur due to service disruption or termination.

   VI. Technical Support and Assistance

Datanet supports only Windows 98SE, Windows ME, Windows 2000, and Windows XP (Home and Professional).  Datanet will not trouble shoot or provide technical support (either directly or over the phone) for any other operating systems.  Datanet does support Outlook Express, Outlook 97, Outlook 2000, and Outlook XP (directly and over the phone).  All other email clients are NOT supported (either directly or by telephone).  Datanet supports Microsoft Internet Explorer web browser only.

Other operating systems, email clients, and web browsers are compatible and will work with Datanet, but no phone in technical support can be provided.  If you require setup or support of other software we may, at our discression, charge a fee for this setup.
